1. Service Description
AthleteX Series is an independent platform allowing athletes to create physical and digital collectible cards based on their personal performance data.
The Seller is a sole trader (micro-entreprise) registered in France, whose full details are set out in the Legal Notice. By placing an order, the Buyer acknowledges having read these Terms and accepts them without reservation. These Terms take precedence over any document issued by the Buyer.
6. Pricing & Payment
All prices are displayed in euros (EUR). Applicable taxes are indicated during the order process in accordance with tax regulations in force and the Buyer's profile. Shipping costs are calculated and displayed before order confirmation. The Seller reserves the right to modify prices at any time; the price charged is the one in effect at the time the order is placed.
Payment is processed securely at the time of order via Stripe (PCI DSS-certified payment service provider). No banking details are stored by AthleteX Series. The order is confirmed only after successful payment authorisation.
7. Right of Withdrawal — Applicable Exclusions
In accordance with Article L221-28, 3° of the French Consumer Code, the 14-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Physical cards, produced to order from the Buyer's photo and data, are excluded from the right of withdrawal from the moment production begins.
In accordance with Article L221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium, whose supply has begun with the consumer's express prior consent and explicit waiver of the right of withdrawal. Digital cards, made available immediately upon payment, are therefore also excluded from the right of withdrawal.
8. Delivery
Physical cards are produced and dispatched within the estimated timeframe shown at checkout. Actual delivery times depend on the destination and shipping method selected. The Buyer will receive a dispatch email with a tracking number where available.
If delivery is delayed by more than 30 days beyond the confirmed estimated delivery date, the Buyer may cancel the order by registered letter with acknowledgement of receipt or any durable written medium, in accordance with Article L216-2 of the French Consumer Code. A full refund will be issued within 14 days of cancellation.
2. Intellectual Property & Independence
- All elements of the AthleteX Series website (code, card templates, graphical interfaces, logos, texts) are the exclusive property of the Seller, protected by French and international intellectual property law.
- AthleteX Series is an independent entity, not affiliated with, endorsed by, or officially connected to any sports event organiser, competition, or brand mentioned on the cards (including HYROX / Deichmann SE).
- Event names and performance data are used solely for identification purposes, based on publicly accessible records, for card personalisation.
3. User Content Responsibilities
By uploading a photo to the platform, the Buyer expressly declares and warrants that:
- they hold the rights to the image or have express prior authorisation from the rights holder;
- the image does not infringe any third-party rights (intellectual property, right to one's own image);
- the image does not contain any illegal, violent, discriminatory, defamatory, or dignity-undermining content.
AthleteX Series reserves the right to refuse production of any card that fails to meet these conditions, without compensation to the Buyer where they have deliberately breached these warranties.
4. Product Nature
Digital cards are personalised visual representations of sports performance data, accessible from the user account. They are not official documents, licences, patents, certifications, or legal instruments of any kind.
Physical cards are collectible printed items, produced in France by an approved printing partner, customised to the Buyer's specifications. They are not official documents. Their value is exclusively commemorative and collector in nature.
9. Legal Guarantees
Physical cards benefit from the statutory guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code). In the event of a conformity defect attributable to the Seller (printing error, card damaged on delivery), the Buyer has 2 years from delivery to take action.
To exercise a guarantee, the Buyer must contact customer service (contact@athletexseries.com) describing the defect and attaching photos of the product received. Where a defect is recognised, the Seller will offer replacement or refund at no cost to the Buyer. The guarantee does not cover defects resulting from an error in the data or photo provided by the Buyer.
5. Seller's Liability
The service is provided "as is". The Seller's liability may only be engaged in the case of proven fault. In any event, the Seller's total liability is limited to the full amount of the order in question. The Seller is not liable for indirect damages (loss of opportunity, commercial loss, etc.).
AthleteX Series cannot guarantee the accuracy of performance data sourced from third-party public sources, and shall not be liable for errors originating from those sources, nor for any subsequent changes made by event organisers.
10. Applicable Law & Jurisdiction
These Terms are governed by French law. In the event of a dispute relating to an order or use of the website, the parties agree to seek an amicable resolution before resorting to legal proceedings (contact: contact@athletexseries.com). Failing amicable agreement within a reasonable period, the dispute shall be brought before the competent French courts under ordinary law rules. Consumers may also bring proceedings before the court of their place of domicile under applicable consumer protection provisions.
11. Consumer Mediation
In accordance with Articles L612-1 and R612-1 of the French Consumer Code, if a dispute cannot be resolved amicably through customer service (contact@athletexseries.com), the consumer may refer the matter free of charge to a consumer mediator within one year of their written complaint to the Seller.
